Il s’agit d’un article du journal anglais the Guardian exposant un rapport rendu par des avocats anglais montrant que les restrictions budgétaires du gouvernement rendent l’exercice de la justice difficile.
Des responsables représentant les intérêts des avocats comme Kate Brunner ou Amanda Pincto ou la politicienne du parti travailliste Yasmine Quershi dénoncent ce problème et expliquent qu'il devient national.
Les tribunaux sont vides et la liste des affaires criminelles n’arrêtent pas de s’allonger provoquant des retards de délais qui ont presque doublé en 9 ans.
Cette situation est niée par le ministère de la justice qui déclare avoir financé en novembre 2019 700 assises supplémentaires en réponse à l'accroissement du nombre d'affaires.
Le ministère précise d'ailleurs que le nombre d'affaires en suspens a diminué de 40% avec un temps de latence au plus bas.

1. What is the role of a solicitor? (2pts)
A solicitor is a laywer qualified to give legal advices. He hears the claimant in the beginning than orientes him to a barrister who is also a lawyer but qualified to plead in higher courts.
Sometimes, he can represent a client in court and generally works in private law firms.
He is also qualified to work on real estate transactions and trusts.
2. Who are the two litigants in a civil trial? Is it the same in a criminal trial? (3pts)
In a civil trial the two litigants are the claimant and the defendant.
The difference between a civil and a criminal trial is that the prosecutor is the one who brings the case against the defendant. In criminal cases the procedure is called prosecution.
III. Write one (and only one) sentence for each of the following pairs of words, showing the contrast between them:
1. claim / offence (2pts)
An offence is a violation of a law when a claim is a legal action in civil lawsuit.
2. magistrate / judge (2pts)
A judge can sit singly and hand down a sentence by himself when a magistrate always needs to be accompanied by two other magistrates in order to hand down their decision and the three of them have equal decision-making.
IV. Translate the following sentences into English:
1. Les délais dans les tribunaux sont de plus en plus longs. (2pts)
The delays in courts are getting longer and longer.
2. Depuis six ans le nombre de procès a diminué de quarante pour cent. (3pts)
