The real property conservatory system that the French had brought with them to Morocco:

 Let’s suppose that you are a notaire* in Casablanca, one day a group of foreign investors (who don’t speak French) came to your office, they have just found a partial of land to buy, the price of this partial is 2 million dirhams. This partial is one hectare of land. They are planning to build a factory on it, they came with the owners of this land. They want to hire you in writing the sales contact, also when it comes to registering their names as new owners in the real property conservatory office.

Part 1: What is the real property conservatory system? What benefits do we get when the real property is registered under this system?

What are the differences between the real property that is registered and the real property that is not registered?

Part 2: The types of ownership that exist in Morocco (mention percentages)

Part 3: If you have real property that is not registered under the system and you want it to be registered what are the legal steps that you must take?

Part 4:  Related to the case. The notaire must ask: is this land registered or not? (if not, they should go to Ladouls) Is it in a rural or urban area? (If it’s in a rural area, foreigner can’t buy it)

*Solicitor he/she can’t represent people in courts

The buyer is the one who pays the fees of the notaire. Thus, he/she should choose the notaire.

Islamic judge is the one who sign the ownership paper

A law does not become a law until it is published in the official bulletin, same with the real property registration.
