1/Who was RBG? (1933-2020)
She was appointed by democrats. She was even the leader of the liberal part.
She is a true New Yorker: she born and raised in Brooklyn, NYC.
She got married in 1954, she was 21, gave birth to her daughter in 1955.
In 1856 RBG enrolled at Harvard Law School (only 9 women out of 500 students).
She transferred to Columbia Law School to follow her husband and graduated first of her class in 1959.
Early in her careen, RBG struggled to find a job due to her gender.
Professor at Rutgers Law School from 1963 to 1972.
She was paid less than her male colleagues because “she had a husband with a well-paid job”.
From 1972 to 1980 she taught at Columbia Law School, where she co-authored the first law school casebook to sex discrimination.
In 1972, RBG co-founded the Women’s Rights Project at the American Civil Liberties Union (ACLU).
She argued six gender discrimination cases before the SCOTUS between 1973 and 1976 winning five. Usually concern equal pay.
Rather than asking the court to end all gender discrimination at once, RBG’s strategy was to aim at specific discriminatory statutes.
She sometimes picked male plaintiffs to show gender discrimination was harmful to both men and women.
RBG’s victories discouraged legislatures from treating women and men differently under the law.
She is credited with making significant advances for women under the 14th amendment’s Equal Protection Clause.
In 1980, RBG was nominated by Jimmy Carter to the US Court of Appeals for the District of Columbia Circuit. She was a liberal judge (de gauche). She was the 2nd Women in the own world.
Bill Clinton nominated RBG as an Associate Justice of SCOTUS in 1993.
Clinton was reportedly looking to increase the court’s diversity: RBG was the second female of the SCOTUS and the first Jewish member since 1969.
At the time of her nomination, Ginsburg was viewed as moderate.
She was progressively viewed as the leader of the liberal wing of the SCOTUS.
During the presidency of Obama, some progressive activists called for RBG to retire so a like-minded successor could be appointed particularly while the Democrats controlled the Senate.
Ginsburg affirmed her wish to remain a justice as long as she was mentally sharp enough.
Same believe she was waiting for H. Clinton to beat Trump before retiring, so that H. Clinton would nominate an even more liberal justice.
2/Fillin RBG’s vacant seat
Rule: when a seat is vacant, it is the responsibility of the incumbent US president to propose a candidate to the US Senate.
In other words, it should be Trump’s responsibility.
The balance of the SCOTUS would be significantly altered. With a 6-3 balance, the Democrats would be almost sure to lose on all divisive issues: abortion, immigration, guns…
